David A. Malinowski, Associate
Mr. Malinowski recently joined the firm and brings close to a decade of experience in handling labor, employment, and employee benefit matters. Recently, Mr. Malinowski successfully worked on an Employee Retirement Income Security Act (“ERISA”) whistleblower case that received national attention. The case ended with a favorable decision in the Sixth Circuit Court of Appeals, and the U.S. Supreme Court declined to grant certiorari.
Along with experience handling matters in court, Mr. Malinowski also has experience handling administrative matters and matters before the National Labor Relations Board (“NLRB”). Of note, Mr. Malinowski prepared and filed an amicus curiae brief addressing one of the NLRB’s landmark cases.
Mr. Malinowski also advises multiemployer benefit plans on a wide range of compliance matters involving ERISA, the Internal Revenue Code (“IRC”), the Patient Protection and Affordable Care Act (“PPACA”), and the Health Insurance Portability and Accountability Act (“HIPPA”). Mr. Malinowski also has experience working on and drafting Plan documents, Summary Plan Descriptions, contracts between the plan and third parties and reviewing investment management agreements.
Prior to his legal career, Mr. Malinowski proudly served in the United States Navy.
Mr. Malinowski earned his Juris Doctor from the University of Detroit Mercy School of Law, graduating Summa Cum Laude. During law school, Mr. Malinowski served as an associate editor on law review and on the moot court board.
Mr. Malinowski received his undergraduate degree from Wayne State University, graduating Magna Cum Laude. Mr. Malinowski also received his Phi Beta Kappa key at Wayne State.
Mr. Malinowski is a member of the International Foundation of Employee Benefit Plans (“IFEBP”) and the Michigan State Bar. Mr. Malinowski is admitted before the State Courts of Michigan, the Federal District Courts of Michigan, and the U.S. Sixth Circuit Court of Appeals.
On a side note, Mr. Malinowski is a member of the Aircraft Owners and Pilots Association (“AOPA”) and is an avid pilot.
